FTC enforcement against unfair or deceptive AI practices is active. The FTC has brought cases involving AI systems that make false claims or produce discriminatory outcomes.

SEC scrutiny of AI claims in financial services and by public companies. Making unsupported statements about AI capabilities can trigger enforcement.

Sector-specific rules: Healthcare (FDA guidance on AI medical devices), financial services (existing fair lending and model risk management rules), transportation (NHTSA on autonomous vehicles).

What’s coming:

Several comprehensive federal AI bills are under consideration. The political environment makes passage uncertain, but some federal framework seems likely within the next few years.

State-level action is accelerating. Colorado passed AI discrimination legislation. California has various AI transparency requirements. Expect more states to act, creating a patchwork that may eventually force federal harmonization.

Other Jurisdictions

UK: Pro-innovation approach with sector-specific guidance rather than horizontal legislation. The UK government is trying to position itself as an AI-friendly jurisdiction, but actual requirements depend on the sector.

China: Comprehensive but different. Regulations focus on algorithmic recommendations, generative AI, and deep synthesis technology. Primarily affects companies operating in China, but the technical requirements influence global AI development.

Canada: AIDA (Artificial Intelligence and Data Act) is working through parliament. Would create a risk-based framework similar to the EU approach but with different specifics.

Australia: Voluntary AI Ethics Framework with growing pressure for binding rules. The government is consulting on mandatory guardrails for high-risk AI.

Practical Compliance Steps

Map your AI inventory. You can’t comply with regulations if you don’t know what AI systems you’re using. Many organizations are surprised by how many AI components exist across their operations.

Classify by risk. Using a framework like the EU Act’s categories, identify which of your applications might be high-risk. Employment decisions, customer credit decisions, and automated decision-making about individuals are common high-risk areas.

Document your systems. Regulators want to understand how AI systems work, what data they use, how they’re tested, and how decisions are made. Start building this documentation now.

Test for bias and accuracy. High-risk applications require evidence that the systems work fairly and accurately. This means testing across demographic groups and monitoring for drift over time.

Establish human oversight. For consequential decisions, ensure there’s meaningful human review, not just rubber-stamping.
